<p>Insurance companies and Trade Unions work in a similar way.  They have panel Solicitors who generally pay in excess of £850 for your personal injury claim.</p>

Campaigners also fear that this will mean victims of medical negligence will not be able to get compensation and the improvements to life that this can provide. In the case of Sharon Redding, oxygen starvation during the birth of her daughter has meant that she needs to provide a lifetime of care that she would not have been able to do without the funds from a compensation settlement she received.</p>
<p>Mrs Redding&#8217;s baby was induced at 41 weeks and shortly after the birth she was transferred to a special care unit where she experienced fits. Some 10 months after the birth, it became evident that there was something seriously wrong with her daughter so Mrs Redding consulted accident compensation solicitors in Manchester. After a long legal battle, the hospital admitted liability and a settlement of a seven-figure sum was finally agreed nearly nine years later.</p>
<p>Mrs Redding&#8217;s daughter is able to walk for short distances and is able to communicate with some speech but will need full time care for the rest of her life. Since receiving the compensation judgement last year, the family have been able to move from a terraced house to an adapted bungalow and have been able to access mobility and communication aids that would not have been possible without the settlement. </p>

			<content:encoded><![CDATA[<p>In another case against DePuy Orthopaedics, a dislocation compensation claim is being made by a  woman from Rugby. Our earlier reported case can be seen in News published on 10th 0f February this year.</p>
<p>In this case, seventy five year old Eileen Lloyd had a hip replacement just over three years ago. After the surgery she suffered from extreme pain in her groin area and the exertion of walking even short distances was a struggle. Mrs Lloyd went to her GP a number of times complaining of pain and was sent for x-rays and physiotherapy but despite doing regular exercise and everything she was advised, nothing seemed to help alleviate the pain.</p>
<p>Two years after her hip replacement, Mrs Lloyd received a letter informing her that DePuy hips were being recalled and after waiting a further six months, she finally had revision surgery. Unfortunately for Mrs Lloyd just six weeks after surgery her new hip dislocated when she leant forward to pick something up. After having her hip put back in place, under general anaesthetic, Mrs Lloyd was understandably cautious when moving around but her hip dislocated again and was put back under general anaesthetic for a second time.</p>
<p>Mrs Lloyd is now seeking dislocation compensation as she says she is practically housebound because she has to avoid walking as much as possible as her hip causes her a great deal of pain and she also needs help with even basic tasks such as washing herself. </p>

			<content:encoded><![CDATA[<p>Car accident back injury compensation and claims for other types of injuries sustained in traffic accidents in South Africa are capped for some victims, which according to a High Court ruling is unconstitutional. </p>
<p>In an appeal in the Western Cape High Court against the South African Road Accident Fund, lawyers argued that a section of the Road Accident Fund Act differentiates between people who are injured as pedestrians or passengers by “innocent” vehicles,  as opposed to those injured by “offending” vehicles.  Claims lodged by some victims are capped whilst others have unlimited claims on compensation. In one example a twenty seven year old victim was paralysed in an incident in 2006 and has been in dispute with the Road Accident Fund for car accident back injury compensation since.</p>
<p>In a land mark case, which centred around three people who had been injured in car accidents between 2005 and 2007, lawyers argued that differentiating between claims is unconstitutional and therefore invalid. The high court agreed and declared the section of the act inconsistent with the constitution, referring the decision for confirmation by Constitutional Court. Parliament now has until August to amend defects in the legislation, including legislation affecting passengers injured in vehicle accidents. If the deadline is not met, the judgement takes effect and all claims will be uncapped.</p>
<p>It has been suggested that thousands of people have been waiting for compensation such as car accident back injury compensation and compensation for other serious injuries with many claimants waiting to up to six years with very little help.</p>

<p>Thirty four year old Mr Holmes, a self employed joiner from Folksworth, was working at a school when an eight-foot sheet of plywood hit him after flying through the air in a strong gust of wind. The plywood board blew across the roof and crashed into Mr Holmes, knocking him out.</p>
<p>In the incident in November 2007 Mr Holmes, sustained severe spinal injuries and left him in need of twenty four hour specialist care. Some four years later he is making some improvements in the use of his shoulders and elbows but still has no function in his legs or hands. </p>

			<content:encoded><![CDATA[<p>Victims of an attack at Macdonalds in Salford are to receive assaults compensation. Manchester resident Sinead Gray appeared before magistrates where she admitted to two charges of assault.<br />
During the hearing she said that on the night of the assault she had drank far too much and deeply regretted her actions. </p>
<p>Magistrates heard that twenty three year old Ms Gray had been on a night out in Manchester city centre with friends before she made the decision to go for a burger. While she was waiting to order food in a car at the McDonald’s on Regent Road she lost her temper and began to shout abuse at the victims, two students who were in a taxi at the front of the queue. Ms Gray was annoyed because the women were taking too long to make their order and she jumped out of the car to confront them.<br />
She then leaned inside and began to punch at both of them in the face.</p>
<p>Ms Gray was ordered to pay the victims £150 each and it has been reported that five pounds<br />
a week will be deducted from her benefits for to cover the assaults compensation. Manchester magistrates also gave her a two-year community order requiring her to attend a women’s programme for thirty one sessions.</p>

			<content:encoded><![CDATA[<p>In an ironic case, a park warden is claiming back injury compensation following a fall whilst he was  erecting health and safety signs. The accident happened in January two years ago, but was only recently made public with the publishing of council documents.</p>
<p>The warden for Leicester City Council was putting up signs to warn the general public to be careful in the ice and snow when the accident happened.  He injured himself when he slipped and in the fall injured his back as well as his neck, wrist and arms. After admitting that the accident could have been avoided, the council has agreed to settle the back injury compensation claim out of court.   A representative of the public sector union Unison suggested that after an accident compensation can help people recover more quickly and it can make up for lost income.</p>
<p>The city council is reported to have said that the council assesses risks and takes action to prevent injury to members of the public and the council staff and to avoid compensation claims being made against the council. In a reaction to this particular incident the council has ordered over a hundred pairs of slip-on shoes with studded soles, to try to avoid other injuries in the winter weather.</p>
<p>Though the final figure has not yet been agreed, it has been reported that the Council has set aside £70,000 for settlement of the back injury compensation case and to cover legal fees.</p>

The incident happened at the Royal Liverpool University hospital and involved organs from a woman who had died at another hospital and was later found to have had a rare form of cancer known as intra-vascular B-cell lymphoma. Mr Law and Mrs Smart, both from Merseyside, were informed a few days after their transplant operations that they would need chemotherapy. It is understood that after six cycles of treatment they were advised that there was no sign of the cancer but they will undergo further scans over the coming months.</p>
<p>Mr Law, a sixty year old father of four, is said to be grateful to the family of the donor and his new kidney is reported to be working well. However he has since suffered from the effects of chemotherapy and medication, including gaining weight, muscle wastage and depression. 			<content:encoded><![CDATA[<p>Industrial accident compensation solicitors involved in the BP Gulf of Mexico oil disaster case have seen the settlement of lawsuits with thousands of individuals affected. It had been previously reported that BP&#8217;s chief executive had suggested that although there was hope of reaching some agreements, the oil company was prepared for a long battle in the multi-billion dollar legal case.</p>
<p>The settlements were agreed ahead of trial but the dispute with the US government remains with       BP accused of being ultimately responsible for the accident at the Deepwater Horizon rig. The  incident led to the death of 11 oil workers and the release of up to 5m barrels of oil into the Gulf. BP&#8217;s case centres on the arguments that the company used a government-approved well design, and relied upon reputable contractors to drill, cement, continuously monitor, and control the well. BP has strongly denied claims of gross negligence but if found guilty the fines to the company could be well above the $40bn (£25bn) estimated liability. A revised schedule for a trial involving the remaining parties is expected.</p>
<p>If the trial goes ahead industrial accident compensation solicitors will be watching proceedings to see if the company succeeds in blocking any references to previous accidents involving the company. Some sources have suggested that only issues related the Gulf will be admissible. </p>

			<content:encoded><![CDATA[<p>Compensation lawyers are seeing NHS staff claim almost £20 million a year in compensation for injuries. It is reported that, in the past five years, the NHS paid out over £90 million in over  9,000 claim cases. According to the figures obtained after Freedom of Information requests, to the NHS Litigation Authority and NHS trusts, the number of employees seeking damages for accidents has increased by nearly a third over the five year period from 2,535 in 2005/6 to 3,287 last year. </p>
<p>It has been reported that £250,000 has been paid out in staff compensation and legal bills by Brighton and Sussex University Hospitals NHS Trust over the last five years. The claims vary widely with examples such injuries caused by as a fall into a hole, an injured knee following a trip, and a neck injury caused by a falling board. The trust either pay out for cases directly or claims are dealt with by compensation lawyers through the national NHS Litigation Authority.</p>
<p>In more unusual cases the Wrightington, Wigan and Leigh NHS Trust is reported to have paid out nearly £4,000 to a nurse who slipped on a piece of potato on a ward floor and nearly £6,000 was paid when an employee fell over after the bottom of his trousers caught on a metal wall bracket.</p>
<p>Whilst it is acknowledged that there will always be cases where payouts are unavoidable, it has been suggested that health authorities keep these are to a minimum by proper management of their facilities and rejecting and fighting claims.
