A self employed builder received a considerable accident compensation award after being injured by a fall on a building site.

Mr Winstone, 47 years old, of Hailey, Oxfordshire, was seriously injured after tripping from first floor scaffolding on a Cornwall building site in 2006. As a result of the accident he sustained severe spinal injuries which resulted in him needing in-patient hospital treatment for over a year. Mr Winstone is also now confined to a wheel chair and it is expected that ongoing treatment for his condition will be required .

Mr Winstone sued the company responsible for the on site scaffolding where the injury was sustained. At the high court in London (March 2011) Gemini Riteway Scaffolding Ltd settled the claim for a lump sum of £1.25 million plus legal costs. The personal injury compensation settlement was agreed without admission of liability.

The award was made in respect of the following;

• Pain and suffering
• Loss of earnings
• The need for future care

Loss of earnings compensation was substantial in this case as his lawyers made clear, “Mr Winstone will never work again.”
