successful cycle accident compensation claim for British Triathlete
A British Triathlete has recently (Sept 2011) been awarded damages relating to a cycle accident compensation claim after a road traffic accident involving a car near Yoxall, in Staffordshire.
Mr Paul Jurczuk successfully made his claim even though the type of injuries he received in the collision meant his recollection of the accident was limited.
Mr Jurczuk was involved in an incident with a car whilst out cycling. The car driver claimed to be unaware that the road that both he and Mr Jurczuk were travelling on was about to narrow requiring Mr Jurczuk to reduce his speed. It was close to this point that the driver decided to pass Mr Jurczuk. The driver alleged that Mr Jurczuk waved his right arm in an aggressive manner and also claimed that Mr Jurczuk deliberately swerved in and out.
The driver continued in his decision to overtake and claimed, as he did so, there was no sound of contact. It was after he passed Mr Jurczuk that the driver heard a crash and on checking his rear view mirror saw that Mr Jurczuk was lying in the road.
As a result of the accident Mr Jurczuk was thrown from his bike and he suffered personal injury and damage to his bike.
