If the accident is partly your fault, you may still be able to make a successful claim subject to contributory negligence. You can still make a claim if you are partly to blame for your accident, as long as someone else is also to blame. This is known as ‘contributory negligence’ for failing to take some responsibility for our own safety
Contributory negligence is usually expressed in terms of a percentage – e.g. the other party is 80% to blame and you are 20% to blame. The effect of this on your claim is that you will still have succeeded for the purpose of being awarded compensation and for the other party having to pay your legal fees in addition to your compensation. However, your compensation will be reduced by the percentage you are held to be contributory negligent i.e. if you were to be awarded £2000 and were held to be 20% to blame then you would receive £2000 less 20% = £1600.
The percentage will obviously vary according to the circumstances of the accident. Although it is not law that cyclists must wear a helmet, an argument for an element of contributory negligence to be applied against cyclists when claiming for a head injury is failure to wear a helmet. We therefore advocate that you cycle safe and always wear a helmet whilst cycling.
